A Brazilian federal prosecutor filed criminal charges on Wednesday against Chevron and drill-rig operator Transocean for a November oil spill, raising the stakes in a legal saga that has added to Chevron?s woes in Latin America and could slow Brazil?s offshore oil boom.
Prosecutor Eduardo Santos de Oliveira also filed criminal charges against 17 local executives and employees at Chevron and Transocean, owner of the world?s largest oil rig fleet. Among the defendants is George Buck, 46, a US national in charge of Chevron?s operations in Brazil, the prosecutor?s office said in a statement.
?The spilling of oil affected the entire maritime ecosystem, possibly pushing some species to extinction, and caused impacts on economic activity in the region,? Santos de Oliveira, a prosecutor in the oil district of Campos de Goytacazes, said in the filing. ?The employees of Chevron and Transocean caused a contamination time bomb of prolonged effect.?
The charges stem from a 3,000-barrel leak in the Frade field, about 120km off the coast of Rio de Janeiro State. They include: failure to realize protocols to contain the leak; failure to take steps to kill the well and stop the drilling process; breach of licenses, legal norms and regulation, including altering documents; and failure to meet legal and contractual duties.
Chevron and Transocean strongly disputed the charges.
?These charges are outrageous and without merit,? Chevron said in a statement. ?Once all the facts are fully examined, they will demonstrate that Chevron and its employees responded appropriately and responsibly to the incident.?
Transocean ?strongly disagrees with the indictments,? spokesman Guy Cantwell said.
Chevron said it stopped the leak in four days. None of the oil that leaked into the Atlantic reached shore or interfered with marine life, it said.
In November, the same prosecutor filed an US$11 billion civil lawsuit over the spill, the largest environmental suit in Brazil?s history. Chevron has already been fined around 200 million reais (US$110 million) in fines for the spill by environmental and oil regulators.
Chevron?s shares dropped 1.1 percent to US$107.91 on Wednesday, to their lowest in nearly a month. Transocean?s US-traded shares dropped 1.1 percent to US$56.77.
Observers warned that the criminal charges could spook foreign companies attracted to Brazil?s offshore oil boom and slow development of more than 50 billion barrels of reserves discovered there since 2007.
?These charges are being used by those who want to shut out foreign investment and vilify foreign companies,? said Adriano Pires, head of energy think tank Brazilian Infrastructure Institute, and a former oil regulator.
The Chevron leak was less than 0.1 percent of the size of the 4 million-barrel BP oil disaster in the Gulf of Mexico in 2010. Transocean also owned the rig in that spill. Past Brazilian oil spills by state-run Petrobras, including some larger ones, have never prompted criminal charges.
In addition to Buck, prosecutors leveled criminal charges against other Chevron and Transocean employees, including five other Americans, five Brazilians, two Frenchmen, two Australians, a Canadian and a Briton. Among them was Guilherme Dantas Rocha Coelho, 38, the Brazilian head of Transocean?s operations in the country.
All were ordered to turn in their passports last Saturday and remain in the country. Each individual will be required to post 1 million reais bail and each company 10 million reais to ensure payment of future fines.

ScienceDaily (Mar. 20, 2012) ? Studies using X-ray and ultraviolet observations from NASA's Swift satellite provide new insights into the elusive origins of an important class of exploding star called Type Ia supernovae.
These explosions, which can outshine their galaxy for weeks, release large and consistent amounts of energy at visible wavelengths. These qualities make them among the most valuable tools for measuring distance in the universe. Because astronomers know the intrinsic brightness of Type Ia supernovae, how bright they appear directly reveals how far away they are.
"For all their importance, it's a bit embarrassing for astronomers that we don't know fundamental facts about the environs of these supernovae," said Stefan Immler, an astrophysicist at NASA's Goddard Space Flight Center in Greenbelt, Md. "Now, thanks to unprecedented X-ray and ultraviolet data from Swift, we have a clearer picture of what's required to blow up these stars."
Astronomers have known for decades that Type Ia supernovae originate with a remnant star called a white dwarf, which detonates when pushed to a critical mass. The environment that sets the stage for the explosion, however, has been harder to pin down.
According to the most popular scenario, a white dwarf orbits a normal star and pulls a stream of matter from it. This gas flows onto the white dwarf, which gains mass until it reaches a critical threshold and undergoes a catastrophic explosion.
"A missing detail is what types of stars reside in these systems. They may be a mix of stars like the sun or much more massive red- and blue-supergiant stars," said Brock Russell, a physics graduate student at the University of Maryland, College Park, and lead author of the X-ray study.
In a competing model, the supernova arises when two white dwarfs in a binary system eventually spiral inward and collide. Observations suggest both scenarios occur in nature, but no one knows which version happens more often.
Swift's primary mission is to locate gamma-ray bursts, which are more distant and energetic explosions associated with the birth of black holes. Between these bursts, astronomers can use Swift's unique capabilities to study other objects, including newly discovered supernovae. The satellite's X-ray Telescope (XRT) has studied more than 200 supernovae to date, with about 30 percent being Type Ia.
Russell and Immler combined X-ray data for 53 of the nearest known Type Ia supernovae but could not detect an X-ray point source. Stars shed gas and dust throughout their lives. When a supernova shock wave plows into this material, it becomes heated and emits X-rays. The lack of X-rays from the combined supernovae shows that supergiant stars, and even sun-like stars in a later red giant phase, likely aren't present in the host binaries.
In a companion study, a team led by Peter Brown at the University of Utah in Salt Lake City looked at 12 Type Ia events observed by Swift's Ultraviolet/Optical Telescope (UVOT) less than 10 days after the explosion. A supernova shock wave should produce enhanced ultraviolet light as it interacts with its companion, with larger stars producing brighter, longer enhancements. Swift's UVOT detected no such emission, leading the researchers to exclude large, red giant stars from Type Ia binaries.
Taken together, the studies suggest the companion to the white dwarf is either a smaller, younger star similar to our sun or another white dwarf. The X-ray findings will appear in the April 1 issue of The Astrophysical Journal Letters; the ultraviolet results appear in the April 10 edition of The Astrophysical Journal.
The ultraviolet studies rely on early, sensitive observations. As Brown's study was being written, nature provided a great case study in SN 2011fe, the closest Type Ia supernova since 1986. Early Swift UVOT observations show no ultraviolet enhancement. According to the findings in an unpublished study led also by Brown, this means any companion must be smaller than the sun.
Swift data on SN 2011fe also figure prominently in unpublished studies led by Alicia Soderberg at the Harvard-Smithsonian Center for Astrophysics in Cambridge, Mass. Preliminary results suggest that the explosion was caused by merging white dwarfs.
Swift launched in November 2004 and is managed by Goddard. It is operated in collaboration with Pennsylvania State University and other national and international partners.

One fact about Aristotle you may not be aware of is the fact that he actually passed these philosophies on to Alexander the Great. That?s quite a lineage.
Today we have the ability to learn from some pretty noteworthy people as well. The principles which were identified thousands of years ago are still very much relevant today. These principles were not invented by the great leaders mentioned above and others you are probably aware of, the principles of self advancement have always been there. It is important to understand that these are NOT manmade; they were developed by a much higher power. These, along with self evident results, are the reason why the principles of personal development simply cannot be argued.
My goal and my purpose over the coming months and years is to share the principles of self betterment with you.. As many of you are aware I recently formed a joint venture with world renowned personal development expert, author and philosopher Bob Proctor.
I realized after 20 years of studying hundreds of books, seminars, webinars, CDs and DVDs all on the topic of personal improvement, that I was only really fulfilled when I was helping others grow more intellectually aware. The key to fully understanding the cerebral side of personal success is that the information must be teachable in order to be learnable. This is Bob?s secret to success and therefore my success, which I do hope will also evolve into your success, for many it already has! That is the goal and the very reason why we are conversing.

Zaman spoke at a seminar on ?Outsourcing outlook for Bangladesh? on the sidelines of Canada Showcase 2012 at Sonargaon Hotel in Dhaka yesterday.
Outsourcing, also known as business process outsourcing, is a way of doing business through a third party. Different companies, including financial institutions, banks, telecom companies and airlines, offer such services.
There is no other sustainable employment than outsourcing business for Bangladesh, said Gurujot Singh Khalsa, chief executive officer of US-based WorldBridge Global Inc.
The country has the potential to create over 200,000 direct and 50,000 indirect jobs and earn $5 billion a year in the next decade through outsourcing, Khalsa said.
The Indian market was a ?zero? when it started outsourcing business there, he said. But the country earned $50 billion from the business last year, he said.
He said there is a market for around $500 billion in the US. India, Philippines, Sri Lanka, Brazil, South Africa and Pakistan are doing good outsourcing business with the US, he said.
WorldBridge plans to invest $150 million in Bangladesh in the next five years, which will create 10,000 direct and 3,000 indirect jobs and help people earn $100 million a year, Khalsa said.
The investment will draw attention of other global companies to invest in Bangladesh, he added.
The Bangladesh government should facilitate tax holiday in the sector for the next 10 years, business visas for five years to the foreigners and provide quality internet at competitive prices comparing with the neighbouring countries, he said.
Khalsa also said the government should build well IT and communication infrastructure and backup international submarine cable to let outsourcing business grow in Bangladesh.
The country failed to perform well in outsourcing although the business began in Bangladesh in 2008, said Ahmadul Hoq Bobby, president of Bangladesh Association for Call Centre Outsourcing.
Outsourcing business is struggling in Bangladesh for a backup cable, he said.
The kind of outsourcing business Bangladesh provides with the help of voice or call centres occupies only 10 percent fields of the business, he said.
Zaman of BASIS said 41 Bangladeshi IT firms are now taking part in two fairs in Europe to get outsourcing business.A2I,

Don't get me wrong. Mobile World Congress is a blast. That we get to work for a week in Barcelona, Spain, is but one perk of this job, and certainly not one that should be taken for granted. As always, it's great to see old friends and make a few new ones, too. And to top it all off, we had great weather this year. (The past two had been cold, wet and relatively miserable, especially for those of us from Florida.)

WASHINGTON (AP) ? Conservative talk show host Rush Limbaugh apologized Saturday to a Georgetown University law student he had branded a "slut" and "prostitute" after fellow Republicans as well as Democrats criticized him and several advertisers left his program.
The student, Sandra Fluke, had testified to congressional Democrats in support of their national health care policy that would compel her college to offer health plans that cover her birth control.
"My choice of words was not the best, and in the attempt to be humorous, I created a national stir," Limbaugh said on his website. "I sincerely apologize to Ms. Fluke for the insulting word choices."
Attempts to reach Fluke by telephone and e-mail were unsuccessful.
Fluke had been invited to testify to a House committee about her school's health care plan that does not include contraception. Republican lawmakers barred her from testifying during that hearing, but Democrats invited her back and she spoke to the Democratic lawmakers at an unofficial session.
President Barack Obama, whose landmark health care overhaul requires many institutions to provide birth control coverage, telephoned her from the Oval Office on Friday to express his support.
The issue has been much debated in the presidential race, with Republican candidates particularly criticizing the Obama plan's requirements on such employers as Catholic hospitals. Democrats ? and many Republican leaders, too ? have suggested the issue could energize women to vote for Obama and other Democrats in November.
Limbaugh was not swayed by Fluke's statements before the House panel.
He said on Wednesday, "What does it say about the college coed ... who goes before a congressional committee and essentially says that she must be paid to have sex? It makes her a slut, right? It makes her a prostitute. She wants to be paid to have sex."
He dug in a day later, refusing to give ground.
"If we're going to have to pay for this, then we want something in return, Ms. Fluke," Limbaugh said. "And that would be the videos of all this sex posted online so we can see what we're getting for our money."
He also asked the 30-year-old Fluke: "Who bought your condoms in junior high?"
And on Friday, still defiant even after Democrats beat back Republican challenges to the new health care law, Limbaugh scoffed at the Democrats' talk of a conservative "war on women."
"Amazingly, when there is the slightest bit of opposition to this new welfare entitlement being created, then all of a sudden we hate women. We want 'em barefoot and pregnant in the kitchen," he said. "And now, at the end of this week, I am the person that the women of America are to fear the most."
By Saturday, six advertisers had pulled sponsorship of Limbaugh's show and Republicans distanced themselves from the comments.
Republican Newt Gingrich said reporters were more excited to talk about Limbaugh's language than Obama's record.
"I think that's a vastly bigger issue than anything a radio host says," Gingrich told reporters in Bowling Green, Ohio.
Even so, Limbaugh decided to yield late Saturday.
"For over 20 years, I have illustrated the absurd with absurdity, three hours a day, five days a week," Limbaugh said in his statement. "In this instance, I chose the wrong words in my analogy of the situation. I did not mean a personal attack on Ms. Fluke."
But he also said the entire debate was "absolutely absurd."
"In my monologue, I posited that it is not our business whatsoever to know what is going on in anyone's bedroom, nor do I think it is a topic that should reach a presidential level," he said.
Limbaugh's critics were not swayed by his statement.
"In all seriousness, this isn't an apology. It's a public relations statement. It's hollow and deceitful. Don't be fooled," tweeted the account StopRush, the effort online to pressure advertisers to abandon the popular host.
And even after the apology, some advertisers still planned to abandon Limbaugh.
"Even though Mr. Limbaugh has now issued an apology, we have nonetheless decided to withdraw our advertising from his show," Carbonite CEO David Friend said on his company's Facebook page. "We hope that our action, along with the other advertisers who have already withdrawn their ads, will ultimately contribute to a more civilized public discourse."
The latest furor involved putting in place a requirement in the president's health care law mandating that religious-affiliated institutions such as hospitals and universities include free birth control coverage in their employee health plans. Georgetown, a Jesuit institution, does not provide contraception coverage in its student health plan.
Many Republicans and some religious organizations accused Obama of waging a war on religion. As protests mounted, Obama said religious employers could opt out, but their insurers still must pay for the birth control coverage.
In his apology, Limbaugh repeated his aversion to the rule.
"I personally do not agree that American citizens should pay for these social activities," he said. "What happened to personal responsibility and accountability? Where do we draw the line? If this is accepted as the norm, what will follow? Will we be debating if taxpayers should pay for new sneakers for all students that are interested in running to keep fit?"

Tighter Internet controls echo measures taken by other ex-Soviet, Central Asian republics, where authoritarian rulers are wary of the role social media played in revolutions in the Arab world and mass protests in Russia.
Government opponents in Tunisia and Egypt used Twitter, Facebook and other platforms to run rings around censors and organize protests that eventually toppled their leaders.
"This morning, we carried out the instruction of the communications service and blocked the sites facebook.com, tjknews.com and zvezda.ru," said one of the providers. "We could not refuse to carry out this instruction."
The communications service was not available for comment. Government officials directed all questions about the shutdown to the service.
Rakhmon has ruled Tajikistan, a mountainous country of 7.5 million people bordering Afghanistan and China, for two decades. Though media operate with less restrictions than in neighboring Uzbekistan, journalists have been detained in recent months.
Authorities have also launched a crackdown on religious groups and imprisoned more than 150 people in the last two years on charges of extremism and attempting to subvert the constitution.
Facebook's popularity has soared in Tajikistan. Membership of the social networking website doubled there last year to 26,000 people. Several Facebook groups openly discuss politics and some users have been critical of the authorities.
Russia-based zvezda.ru had published an article on Friday entitled: 'Tajikistan on the eve of a revolution'. Local news site tjknews.com republished the article.
Access to microblogging site Twitter appeared unaffected.
Tajikistan is the most impoverished of 15 former Soviet republics. Its economy relies heavily on exports of aluminum and cotton, as well as remittances from around 1 million migrant laborers, most of them young men living in Russia.
Rakhmon must stand again for election by November 2013. Victory would secure seven more years as president of the mainly Muslim country.
